Safety Management (Legal Perspectives and Cases Update)



Introduction

This course facilitates engineers/professionals of all disciplines and corporate executives tasked with responsibility for Safety Management to keep abreast of the Legal perspectives, with illustrations by relevant cases and an update in 2017. Upon completion of the course, participants shall be able to:

a.              Appreciate the legal framework related to statutory requirements relevant to Occupational and Industrial Safety, the duties and responsibilities of companies and individuals affecting employers, employees, proprietors, principal contractors, sub-contractors, occupiers, engineers and corporate managerial staff; 

b.              Understand in general the criminal and civil liabilities related to Safety Management, as illustrated in relevant cases with an update on 2017 newly decided cases.

本課程有助於負責安全管理的工程師專業人士和企業高管人員及時了解有關法律觀點;導師將會分析有關的案件和2017年的更新案件。課程完成後,參加者應能:

a.             了解與職業和工業安全有關的法定要求的法律框架,和影響僱主、僱員、業主、總承包商、分包商、佔用人、工程師和公司管理人員的公司和個人的職責和責任;

b.            了解與安全管理相關的刑事和民事責任的一般情況,有關案件所示,和2017年的最新案件更新。

Trainer:

 

Ir Derek Fung

Derek, with qualifications in LLB, MA (Arbitration), MSc, FCIArb, CEng, MIET, MHKIE, is a Barrister and Engineer.  He is now a practicing Barrister in both Civil / Criminal work, including Arbitration / Construction disputes, Civil / Commercial litigations, Planning / Environmental, Regulatory / Criminal offences, Matrimonial and Probate.  He is also on the HKIE List of Arbitrators.  Before 2014, Derek worked as an Engineer in the Construction industry.  He has over 25 years’ extensive experience in major railway and infrastructure projects, with responsibility in Project Management, Procurement, Contracts Management and Claims Assessment.
